Exclusion guerre et opération cyber, réassurance traité cyber (Exclusion B)
A write-back by reference to the underlying clause. It excludes war, cyber war and any cyber operation causing major detrimental impact to a state, but carries a Difference in Conditions provision letting the reinsurer follow the underlying war and cyber exclusion, provided that exclusion is Lloyd's Type 3 compliant.
War, cyber war operations and any cyber operation rendering a state impacted, save where the DiC mechanism picks up the underlying direct clause.
For cyber reinsurance treaties that want the exclusion aligned with the cedant's direct clause, so long as that clause is Type 3 compliant. It carries attribution language and its own definition of a Type 3 exclusion.
Aligning with the underlying through the DiC means checking the direct clause stays Type 3 compliant over time; any drift by the cedant outside Type 3 takes the DiC benefit away.
Issued 1 March 2024 (bulletin LMA24-011-CM). It brings the Type 3 exclusion concept into the body of the clause through the Difference in Conditions mechanism.
