Article 757 B of the French Tax Code (premiums paid after age 70)

Its 4 cross-references, woven across the glossary's 18 categories

The tax regime for life insurance premiums paid after the insured turned 70: they fall into the taxable estate beyond an overall allowance of 30,500 euros, while investment gains remain exempt.

Definition

Article 757 B of the French General Tax Code covers premiums paid after the insured's seventieth birthday. Unlike Article 990 I, it does not create a separate levy: the premiums are added back into the estate and subject to inheritance tax according to the family relationship between the insured and each beneficiary. An allowance of 30,500 euros applies, but it is overall, shared among all beneficiaries and all policies, not per beneficiary. Only premiums are taxed: interest and gains accumulated on the policy are exempt, which keeps the arrangement attractive for a long-term investment. The split between the two regimes is made premium by premium according to the payment date, which is why the insurer must track the insured's age at each payment. The surviving spouse and civil partner remain exempt.

Example

A policyholder who pays in 100,000 euros at age 74 on a policy worth 160,000 euros at her death in 2024 passes on 60,000 euros of exempt gains; only 69,500 euros of premiums, after the 30,500 euro allowance, enter her children's inheritance tax base.
