Robotaxi and autonomous vehicle insurance

Cover for autonomous vehicles, shifting liability from the driver toward the manufacturer and the driving-system developer.

Definition

Robotaxi and autonomous vehicle insurance covers the cover adapted to vehicles able to operate without human intervention, whose commercial deployment is progressing in some cities. The fundamental change it introduces is the shift of liability: when the vehicle drives itself, an accident stems less from a driver's fault than from a failure of the driving system, which transfers exposure toward the manufacturer and the software publisher, on product liability grounds. This shift upends the historical motor insurance model, based on the driver's individual liability and the law of large numbers applied to millions of policies. The loss profile changes in nature: a software failure can simultaneously affect a whole fleet sharing the same system, creating an unprecedented accumulation risk, like a serial defect. For the insurer, the robotaxi raises the question of data, of shared liability along the technological chain and of a transition from a mass market toward a product and fleet liability market.

Example

An accident caused by the failure of a robotaxi's driving system engages the liability of the manufacturer and software publisher rather than a driver, shifting risk toward product liability.
