Conformity assessment is the procedure by which a provider of a high-risk artificial intelligence system must demonstrate, before market placement, that its system meets the requirements of the EU AI Act: risk management, data quality, technical documentation, transparency, human oversight, robustness and cybersecurity. Depending on the system's category, this assessment may be conducted internally by the provider or require the intervention of a notified third-party body, leading to a marking attesting compliance. This mechanism, inspired by European product law, transposes to AI a logic of prior certification. For insurance, conformity assessment creates both an obligation whose breach engages liability, and a risk-control signal usable in underwriting: a properly assessed and documented system presents a better-controlled risk profile. Compliance or not with this procedure becomes an element in assessing liability in case of damage and a relevant criterion for liability and product liability cover.
